...been lawfully retired from the Nigerian Army in accordance with the extant Terms and Conditions of Service (TACOS) applicable to the Nigerian Army. "First, there is no record anywhere that Lt Col Jock was tried by Court Martial. Additionally, our records show that Lt Col Jock has been lawfully retired from the Nigerian Army in accordance with the extant Terms and Conditions of Service (TACOS) applicable to the Nigerian Army. By TACOS, an officer has 3 attempts to be promoted to the next rank. Any officer who does not get promoted after these 3 attempts no longer has any further prospects of promotion. Such an officer is thereafter advised to apply to retire voluntarily or he would be compulsory retired. This was the case with Lt Col Jock. He had missed all 3 attempts at promotion from the rank of Lt Col to Col. He had also reached the maximum age for the rank of Lt Col, hence he was qualified to be retired on that rank and he was duly retired. 'Lt Col Jock has refused to collect his retirement letter or process his retirement benefit. The retirement of the officer is in conformity with extant regulations. The Nigerian Army, like other governmental organisations which employ labour is also empowered to relieve such personnel of such employment. The Nigerian Army is only obliged to ensure that such relief of employment is accordance with law and relevant regulations. Lt Col Jock was administratively retired from the NA. His retirement was neither punitive nor consequent upon a judicial action', he said. The Army spokesman stated that the current law suit by Jock as reported is filed at the Federal High Court, Abuja. Lt Col Jock had earlier filed a similar suit at the Federal High Court in Kaduna. 'According to the Newspaper reports, he had abandoned the suit at Kaduna because the Chief Judge of the Federal High Court did not accede to his request to assign the case to a judge of his (Jock) choice. 'The present Law suit and the attendant newspaper publication are the latest in a series of uncoordinated and disjointed actions by Lt Col Jock to harass and intimidate the Nigerian Army and the judiciary to accede to his requests which have not merit in law. The Nigerian Army is not his only target in his desperate quest to achieve an end known only to him. Other victims of his attack include the Chief Judge of the Federal High Court who was accused of refusing to personally handle the matter. Other Judges of the High Court have not fared any better. All lawyers in Kaduna axis are also accused of being involved in the conspiracy against him. In fact anybody or authority who does not accede to his request, no matter how unlawful will also become a target of his attack,' the statement added. Copyright © 2009 This Day."
